Welcome to Development Toolboxx. These Terms of Service (“Terms”) form a binding agreement between you and Development Toolboxx (“we”, “our”, or “us”) governing your use of our website, mobile application, and related services (“Services”). By using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.

Please read the Terms of Service and Privacy Policy carefully before you use the Website or Application. By using the Website or Application, you accept and agree to be bound and abide by the Terms of Service and Privacy Policy. If you do not agree with the Terms of Service and Privacy Policy, you may not use this Website and Application.

1. Eligibility

You must be at least 13 years old (or the legal age in your jurisdiction) to use the Services. If you are under the age of majority, you must have your parent or legal guardian’s consent.

2. No Medical Advice

Development Toolboxx is not an alternative to medical advice. The Services are for informational and educational purposes only and are not intended to be a substitute for professional medical advice, diagnosis, or treatment. We do not provide medical advice. Always consult a healthcare professional before beginning any activities described in our content, especially concerning children. Use the information at your own risk.

You are solely responsible for making sure that your child is safe. Never perform any activity or exercise that you believe your child might not be developmentally ready to do. If you have any doubt about your child’s developmental ability to perform any activity or exercise, ask a healthcare professional before performing it.

 

Any information regarding your child’s progression, development, or ability to perform the exercises or activities provided by our Services is meant to be suggestive in nature as it is impossible to determine every child’s proper developmental progression as each child develops in a different manner and pace. You are solely responsible for determining your child’s developmental process and whether it is appropriate and safe to conduct any suggested activities and exercise with your child. If you have any suspicion of a developmental delay or any other health issue with your child, you should consult a physician or appropriate professional immediately.

 

You are solely responsible for determining whether your child is physically or mentally able to perform any of the exercises or activities suggested by our Services. We strongly urge you to consult a doctor or appropriate healthcare provider before using any information obtained in our Services, especially if your child has a special medical condition.

 

You are solely responsible for determining if your child requires treatment from a certified health professional. If at any time during the performance of any activity or exercise suggested in our Services your child experiences any irregular physical, mental, emotional, or behavioral response, stop immediately and consult a doctor. Do not resume performance of any of our suggested activities or exercises until obtaining prior approval from your child’s health care professional. Never disregard professional medical advice or delay in seeking it for any reason.

 

ANY USE OF THE SERVICE BY ANY PARTY, INCLUDING YOU, IN ANY HIGH RISK APPLICATION IS DONE AT THE USER’S OWN RISK, WITHOUT ANY WARRANTY. AS USED HEREIN, A “HIGH RISK APPLICATION” IS ANY USE WHERE THE FAILURE OF THE SERVICE COULD CAUSE SERIOUS RISK, INCLUDING RISK OF INJURY TO PERSONS OR PROPERTY, OR A LIFE-THREATENING SITUATION, INCLUDING BUT NOT LIMITED TO, MEDICAL, EMERGENCY SERVICES, OR OTHER SIMILAR APPLICATIONS.

 

WE ARE NOT PROVIDING ANY MEDICAL ADVICE OR SERVICES VIA THE SERVICE AND IT SHOULD NOT BE RELIED UPON AS A SUBSTITUTE FOR CONSULTATIONS WITH QUALIFIED PROFESSIONALS WHO ARE FAMILIAR WITH YOUR AND YOUR CHILD’S INDIVIDUAL NEEDS. PLEASE CONSULT YOUR DOCTOR AS NECESSARY.

The understanding, agreement, and acceptance of the disclaimer notice and the Terms of Service contained herein shall be for all legal purposes as perfected between the Parties when You: (i) access any of the Internet Sites; (ii) receive any of the Services provided by Development Toolboxx, either through any of the Internet Sites or through any of the Applications; and/or (iii) carry out the use and/or execution of any of the Applications, by carrying out the activities permitted within their functionality. In this regard, in the event of any of the events under which You accept these Terms of Service in accordance with the foregoing, Development Toolboxx may execute measures to validate Your identity and Your acceptance of these Terms of Service.

 

Without prejudice to the foregoing, in the event that You act on behalf of another person (individual or legal entity), You accept, acknowledge, and warrant that: (i) You have sufficient legal capacity to bind such third party to these Terms of Service, (ii) have read and fully understood this Agreement, and (iii) accepts this Agreement on behalf of the person You represent. If You do not have sufficient legal capacity to subject such third parties to these Terms of Service, You must not use the Services offered by Development Toolboxx.

3. Your Responsibilities

You are responsible for your own device, Internet connection, and related fees. 


You agree not to: Violate any laws or third-party rights. Harass, abuse, or harm others. Post or share inappropriate content. Reverse engineer or copy our Services.Use the Services for unauthorized commercial purposes.


You must notify us of any unauthorized use of your account and keep your login credentials secure.

Devices and Software. You must provide certain devices, software, and data connections to use our Services, which we otherwise do not supply. In order to use our Services, you consent to manually or automatically download and install updates to our Services. You also consent to sending you notifications via our Services from time to time, as necessary to provide our Services to you.

 

Fees and Taxes. You are responsible for all carrier data plans, Internet fees, and other fees and taxes associated with your use of our Services. The Service will be available to paid subscribers.

4. User Content and Conduct

You agree not to upload content that is unlawful, abusive, or infringes on others’ rights. We reserve the right to remove content that violates these Terms.

Our Terms and Policies. You must use our Services according to our Terms of Service and Privacy Policy. If you violate our Terms of Service or policies, we may take action with respect to your account, including disabling or suspending your account and, if we do, you agree not to create another account without our permission. Disabling or suspending your account will be in accordance with the “Termination” section below.

Legal and Acceptable Use. You must access and use our Services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our Services in ways that:

  • Violate, misappropriate, or infringe the rights of Development Toolboxx, our users, or others, including privacy, publicity, intellectual property, or other proprietary rights.

  • Are illegal, obscene, defamatory, threatening, intimidating, harassing, hateful, racially or ethnically offensive, or instigate or encourage conduct that would be illegal or otherwise inappropriate, such as promoting violent crimes, endangering or exploiting children or others, or coordinating harm.

  • Involve publishing falsehoods, misrepresentations, or misleading statements.

  • Impersonate someone.

  • Involve sending illegal or impermissible communications such as bulk messaging, auto-messaging, auto-dialing, and the like.

  • Involve any non-personal use of our Services unless otherwise authorized by us.

 

Harm to Development Toolboxx or Our Users. You must not (or assist others to) directly, indirectly, through automated or other means, access, use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sublicense, transfer, display, perform, or otherwise exploit our Services in impermissible or unauthorized manners, or in ways that burden, impair, or harm us, our 

Services, systems, our users, or others, including that you must not directly or through automated means:

  • Reverse engineer, alter, modify, create derivative works from, decompile, or extract code from our Services.

  • Send, store, or transmit viruses or other harmful computer code through or onto our Services.

  • Gain or attempt to gain unauthorized access to our Services or systems.

  • Interfere with or disrupt the safety, security, confidentiality, integrity, availability, or performance of our Services.

  • Create accounts for our Services through unauthorized or automated means.

  • Collect information of or about our users in any impermissible or unauthorized manner.

  • Sell, resell, rent, or charge for our Services or data obtained from us or our Services in an unauthorized manner.

  • Distribute or make our Services available over a network where they could be used by multiple devices at the same time, except as authorized through tools we have expressly provided via our Services.

  • Create software or APIs that function substantially the same as our Services and offer them for use by third parties in an unauthorized manner.

  • Misuse any reporting channels, such as by submitting fraudulent or groundless reports or appeals.

Any views, opinions, or statements expressed in user-submitted or third-party content made available through the Services are solely those of the respective authors and do not reflect the views of Development Toolboxx. We do not guarantee the accuracy, completeness, or reliability of such content and assume no responsibility for any errors, omissions, or legal claims related to it. Responsibility for the intellectual property rights of such content rests solely with the content creator.

 

Rules of Conduct

By using this Service, you agree that you shall not send, upload, or distribute any information that:

Is defamatory, abusive, harassing, threatening, or an invasion or violation of any right or privacy of another person; is intolerant, hateful, racist, or offensive; is violent, vulgar, obscene, pornographic, or sexually explicit; or causes harm or is likely to cause harm to any person or entity.

Is illegal or encourages illegal activities or the discussion of illegal activities with the intent to commit them, including presentation that is or represents an attempt to engage in child pornography, harassment, sexual harassment, fraud, trafficking in stolen or obscene material, sale of drugs and/or drug abuse, theft, or conspiracy to commit any criminal activity.

  3. Infringes or breaches any right of a third party including: copyrights, patents, trademarks, secrets, or any other proprietary or contractual rights; privacy rights (specifically, you must not distribute other people’s personal information without their express consent) or publicity; or any confidentiality obligations.

  4. Is commercial, business-related, or advertises or offers to sell any product, service (whether for profit or not), or solicits others (including solicitation of donations or contributions).

  5. Contains viruses or any other harmful components, or otherwise harms our site, the application, or any connected network, or interferes with any person’s or entity’s use and enjoyment of our site, services, or information.

  6. Does not pertain to the designated topic or relevant topic of public forum; violates any restrictions applicable to public fora, including age restrictions and procedures; or is antisocial, disruptive, or destructive, including “flaming,” “spamming,” “flooding,” “trolling,” and “griefing” as these terms are commonly understood and used on the Internet.

We cannot guarantee that other users will comply with the Rules of Conduct or any other provision of these Terms. You acknowledge and agree that you assume all risk of harm, loss, or damage arising from any such non-compliance by other users.

 

Confidentiality

In addition to general terms contained herein, you acknowledge that you will be privy to, and access, highly confidential, personal information contributed by you and others within the Service to which you have been granted permission to access. You agree to keep all information, directly or indirectly related to the individuals contained within this Service confidential and shall not disclose any information contained within this Service to anyone, regardless of relationship to the person, without the prior, written consent of the parent or legal guardian of such individual.

 

Keeping Your Account Secure. You are responsible for keeping your device and your Development Toolboxx account safe and secure, and you must notify us promptly of any unauthorized use or security breach of your account or our Services. You agree that you will be responsible and liable for all uses of the Service under your Development Toolboxx Account, including without limitation, compliance with all applicable laws and regulations. In addition to the other limitations of liability set forth below, you further agree that Development Toolboxx will not be liable for any cost, loss, damages, or expenses arising out of a failure by you to maintain the security of your Development Toolboxx Account.

5. Intellectual Property

These Terms of Service, among other things, prohibit you from, and you agree you will not:

  • Reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit materials from the Service.

  • Use illustrations, photographs, video or audio sequences, or any graphics separately from the accompanying text.

  • Delete or alter any copyright, trademark, or other proprietary rights notices from copies of materials in any way that violates any applicable federal, state, local, or international law or regulation (including, without limitation, any laws regarding the export of data or software to and from Australia or other countries).

  • Use the Service for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way by exposing them to inappropriate content, asking for personally identifiable information, or otherwise.

  • Transmit, or procure the sending of, any advertising or promotional material, including “junk mail,” “chain letter,” or “spam” or any other similar solicitation.

  • Impersonate the Service, a Company employee, another user, or any other person or entity, including, without limitation, by using e-mail addresses associated with the foregoing.

  • Use the Service in any manner that could disable, overburden, damage, or impair the site or interfere with, or restrict, any other party’s use of the Service, including their ability to engage in real-time activities through the Service.

  • Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.

  • Use a manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent.

  • Use a device, software, or routine that interferes with the proper working of the Service.

  • Introduce viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful.

  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.

  • Attack the Service via a denial-of-service attack or a distributed denial-of-service attack, or otherwise attempt to interfere with the proper working of the Service.

 

Everything located on or in this Service, including the Microsites, is our exclusive property and can be used with the express permission of the copyright and/or trademark owner. 

ANY COPYING, DISTRIBUTING, TRANSMITTING, POSTING, LINKING, DEEP LINKING, OR OTHERWISE MODIFYING OF THIS APPLICATION, WEBSITE, OR ANY OF THE MICROSITES WITHOUT OUR EXPRESS WRITTEN PERMISSION OF DEVELOPMENT TOOLBOXX IS STRICTLY PROHIBITED. Any violation of this policy may result in a copyright, trademark, or other intellectual property right infringement that may subject the End User to civil and/or criminal penalties.

6. Account Deletion

To delete your account:

 

  • Log into the app, go to “Account Settings,” and select “Delete Account,” or

  • Email us at info@developmenttoolbox.au with the subject “Account Deletion Request”.

 

Data may be retained for legal compliance or dispute resolution. Deleted data cannot be recovered. You will lose access to your account and all associated data. Ensure you back up any important information before requesting deletion.

7. Link to Third Parties

We are not responsible for the content or accuracy of third-party websites linked through our Services. Use them at your own risk.

If the Service contains links to other sites and resources provided by third parties, these links are provided for your convenience only. Aesop’s Fables. This includes links contained in advertisements, including banner advertisements and sponsored links. We have no control over the contents of those sites or resources and accept no responsibility for them or for any loss or damage that may arise from your use of them. If you decide to access any of the third-party applications linked to this Service, you do so entirely at your own risk and subject to the Terms of Service of use for such applications. We may disable all or any social media features and any links at any time without notice at our discretion.

Parenting may include hyperlinks to third-party content or images. You acknowledge and agree that Parenting is not responsible for and does not endorse any advertising, products, or resources available from such resources or websites. The intellectual property rights in the said third-party images/content do not belong to Parenting. These links are provided for your information and convenience only and are not an endorsement by the Parenting of the content of such linked websites or third parties. Parenting has no control over the contents of any linked website and is not responsible for these websites or their content or availability. Thus, we are not responsible for the content or accuracy of any third-party resource or for any loss or damage of any sort resulting from the use of, or for any failure of, products or services provided at or from a third-party resource. See our Privacy Policy for how we collect, store, and use your data. We do not collect personally identifiable information without your knowledge. You consent to our sharing of your information with third parties to deliver our Services.

9. Service Modifications

We may update or suspend the Services without notice. We are not liable for any resulting loss.

We are always trying to improve our Services. That means we may expand, add, or remove our Services, features, functionalities, and the support of certain devices and platforms. Our Services may be interrupted, including for maintenance, repairs, upgrades, or network or equipment failures. We may discontinue some or all of our Services, including certain features and the support for certain devices and platforms, at any time. Events beyond our control may affect our Services, such as events in nature and other force majeure events.

We may modify, suspend, or terminate your access to or use of our Services anytime for any reason, such as if you violate the letter or spirit of our Terms of Service or create harm, risk, or possible legal exposure for us, our users, or others. We may also disable or delete your account if it does not become active after account registration or if it remains inactive for an extended period of time. The Terms of Service and Privacy Policy will survive any termination of your relationship with Development Toolboxx.

Due to the nature of the Internet, we might have to carry out system maintenance and/or upgrading and/or testing and/or repairs and/or other related work (the “Maintenance”). We may at our sole discretion and without assigning any reason whatsoever at any time deactivate and/or suspend the User’s access to Development Toolboxx Services (as the case may be) without notice to carry out Maintenance. Without prejudice to any other provisions of this Terms of Service, we shall not be liable for any loss and/or damage and/or costs and/or expense that the User may suffer or incur, as a result of such deactivation and/or suspension.

 

Delay in Services

Development Toolboxx shall not be liable for any loss or liability resulting, directly or indirectly, from delays or interruptions due to electronic or mechanical equipment failures, telephone interconnect problems, defects, weather, strikes, walkouts, fire, acts of God, riots, armed conflicts, acts of war, or other like causes. 

The Service shall have no responsibility to provide you access to the Services while interruption of the Services is due to any such cause shall continue.

10. Disclaimers and Limitation of Liability

The Services are provided “as is” without warranties. We are not responsible for:

  • Errors or omissions in content.

  • Viruses or technical issues.

  • Loss of data, profits, or business.

WE DO NOT WARRANT THAT ANY INFORMATION PROVIDED BY US IS ACCURATE, COMPLETE, OR USEFUL, THAT OUR SERVICES WILL BE OPERATIONAL, ERROR FREE, SECURE, OR SAFE, OR THAT OUR SERVICES WILL FUNCTION WITHOUT DISRUPTIONS, DELAYS, OR IMPERFECTIONS. WE DO NOT CONTROL, AND ARE NOT RESPONSIBLE FOR, CONTROLLING HOW OR WHEN OUR USERS USE OUR SERVICES OR THE FEATURES, SERVICES, AND INTERFACES OUR SERVICES PROVIDE. YOUR RIGHTS WITH RESPECT TO THE DEVELOPMENT TOOLBOXX ARE NOT MODIFIED BY THE FOREGOING DISCLAIMER IF THE LAWS OF YOUR COUNTRY OR TERRITORY OF RESIDENCE, APPLICABLE AS A RESULT OF YOUR USE OF OUR SERVICES, DO NOT PERMIT IT.

 

 

We will not be liable for indirect, special, or consequential damages (or any loss of revenue, profits, or data) arising in connection with this Terms of Service and the Privacy Policy and Service, even if we have been advised of the possibility of such damages. Further, our aggregate liability arising with respect to this Terms of Service will not exceed the amount paid or payable for the services provided to you under this 

 

Terms of Service.In no event shall Development Toolboxx, its proprietors, affiliates, group companies, associated entities, officers, directors, employees, consultants, or agents, be liable to you for any direct, indirect, incidental, special, punitive, exemplary, or consequential damages of any kind including but not limited to loss of profits, business interruption, and/or loss of information or data whatsoever resulting from any 

 

(i) errors, mistakes, or inaccuracies of content, 

(ii) personal injury or property damage, of any nature whatsoever, resulting from your access to and use of our Services, 

(iii) any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, 

(iv) any interruption or cessation of transmission to or from our Services, 

(v) any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our Services by any third party, and/or 

(vi) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available via the Services, whether based on warranty, contract, tort, or any other legal theory, and whether or not the company is advised of the possibility of such damages. The foregoing limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction.

 

 

You specifically acknowledge that Development Toolboxx shall not be liable for user submissions or the defamatory, offensive, or illegal conduct of any third party and that the risk of harm or damage from the foregoing rests entirely with you.

 

User Content and Moderation

 

Development Toolboxx is not obligated to monitor or pre-screen user-submitted content. However, we reserve the right—but are not obligated—to review, remove, or restrict access to any content at our sole discretion and for any reason, including violations of these Terms. We do not guarantee the accuracy, completeness, or reliability of user or third-party content and are not responsible for any related errors, omissions, or legal issues. Responsibility for such content—including its legality and intellectual property rights—rests solely with the content creator.

By using Development Toolboxx, you acknowledge that you have read, understood, and agreed to the terms of this Privacy Policy. If you do not agree with any aspect of this policy, please refrain from using our Website and Application.

11. Indemnity

You agree to defend, indemnify, and hold harmless Development Toolboxx, its employees, affiliates, directors, officers, agents, and their successors and assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses, including attorney’s fees, caused by or arising out of claims based upon your actions or inactions, which may result in any loss or liability to us or in relation to the non-fulfillment of any of your obligations under this Terms of Service and Privacy Policy or arising out of your violation of any applicable laws, regulations including but not limited to Intellectual Property Rights, payment of statutory dues and taxes, claim of libel, defamation, violation of rights of privacy or publicity, loss of service by other subscribers, and infringement of intellectual property or other rights. Your rights with respect to Development Toolboxx are not modified by the foregoing indemnification if the laws of your country or territory of residence, applicable as a result of your use of our Services, do not permit it. This clause shall survive the expiry or termination of this Terms of Service.

12. Governing Law

The laws of Australia govern our Terms of Service, as well as any Disputes, whether in court or arbitration, which might arise between Development Toolboxx and you, without regard to conflict of law provisions

13. Changes to the Terms of Service

Development Toolboxx reserves the right to alter or delete material from this Service at any time without notice. Please check often for updates, as we reserve the right, in our sole discretion, to modify the Privacy Policy and Terms of Service at any time, and your use of the Service indicates your acceptance of any revisions to these terms.

14. Time Limit to Bring a Claim or Dispute

THESE TERMS OF SERVICE ALSO LIMIT THE TIME YOU HAVE TO BRING A CLAIM OR DISPUTE, INCLUDING THE TIME TO START AN ARBITRATION OR, IF PERMISSIBLE, A COURT ACTION OR SMALL CLAIMS PROCEEDING TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. We and you agree that for any Dispute (except for the Excluded Disputes defined below) we and you must bring Claims (including commencing an arbitration proceeding) within one (1) year after the Dispute first arose; otherwise, such Dispute is permanently barred. This means that if we or you do not bring a Claim (including commencing an arbitration) within one year after the Dispute first arose, then the arbitration will be dismissed because it was started too late.

15. Other

Unless a mutually executed agreement between you and us states otherwise, our Terms of Service make up the entire agreement between you and us regarding Development Toolboxx and our Services and supersede any prior agreements. We reserve the right to designate in the future that certain of our Services are governed by separate terms (where, as applicable, you may separately consent).

 

Our Services are not intended for distribution to or use in any country or territory where such distribution or use would violate local law or would subject us to any regulations in another country or territory. We reserve the right to limit our Services in any country or territory. Our Terms of Service are written in English. Any translated version is provided solely for your convenience. To the extent any translated version of our Terms of Service conflicts with the English version, the English version controls. Any amendment to or waiver proposed by you of our Terms of Service requires our express consent.

 

We may amend or update these Terms of Service. Your continued use of our Services confirms your acceptance of our Terms of Service, as amended. We hope you will continue using our Services, but if you do not agree to our Terms of Service, as amended, you must stop using our Services by deleting your account.
